The owners of condominium units at Fair Isle can breathe a sigh of relief after the Third District Court of Appeal’s recent overturning of the dismissal of a lawsuit filed against a hotel and spa operator in Coconut Grove.
Many of the condo owners’ concerns will likely fade away, given that the proposal of adding a private condo tower would mean access for only owners, renters and visitors, according to a column on the website of law firm Bilzin Sumberg.
A three-judge panel found that the Grove Isle Association’s 2009 suit was improperly dismissed by a Miami-Dade Circuit Court judge.
