The Miami City Commission signed off last week on the settlement of a legal dispute over the transfer of the development rights of the former Bayside Motor Inn.
Motel developer Avra Jain bought the motel site at 5101 and 5125 Biscayne Boulevard last year, with plans to renovate the structures. She has agreed not to make Bayside taller than 35 feet, in exchange for sell her transfer of development rights. Therefore, she will be able to sell the rights to another developer who would then build extra floors on a separate high-rise project nearby.
“It’s a win-win,” Lucia Dougherty, an attorney who represented Jain, told the Miami Today News.
In 2004, the original Bayside developer received a permit from the Planning and Zoning Department to build a 63-unit, eight-story mixed-use building. After the Morningside Civic Association protested the permit issuance over the planned height, the Miami City Commission reversed the zoning board approval. [Miami Today News] — Mark Maurer
